Terms of sale
Purpose
These terms of sale govern subscription to and billing for the KARD platform between the publisher (the “Provider”) and the professional Customer.
They apply to loyalty and membership offers, except written special terms (Enterprise / Network quotes) which prevail in case of conflict.
Offers and pricing
Loyalty plans (price incl. all taxes / month, subject to the Pricing page in force): Starter €29, Pro €39, Business €59; Enterprise on quote.
Membership plans (price incl. all taxes / month): Essentiel €19, Club €39; Network (membership Enterprise) on quote.
Each plan includes the features and quotas described on the Pricing page or quote. Displayed prices are all-inclusive: the Provider benefits from the French VAT exemption franchise (Article 293 B CGI) and does not charge VAT. Invoices state “VAT not applicable, Art. 293 B CGI”. Prices may change for future periods with prior notice.
Free trial
When a fourteen (14) day free trial is offered, the Service may be tested without payment obligation during that period, under the conditions shown at signup.
At the end of the trial, the subscription becomes paid under the chosen plan unless cancelled or payment details are not activated before the trial ends.
Subscription and contract formation
The contract is formed upon online subscription validation (account creation and, where applicable, payment method entry) or upon acceptance of a signed quote.
The Customer acknowledges having read the terms of use, terms of sale and privacy policy before subscribing.
Payment and invoicing
Unless otherwise stated, subscriptions are billed in advance on a monthly basis by card or another method offered via Stripe.
The Customer authorises recurring charges matching their plan. Invoices/receipts are made available via the Service or on request at contact@getkard.fr.
If payment fails, the Provider may remind the Customer, suspend access after notice, and/or terminate the subscription if the default persists.
Term, renewal and cancellation
Unless otherwise stated, the subscription is monthly and renews automatically for successive periods of the same length.
The Customer may cancel at any time from their account (when available) or by email to contact@getkard.fr. Cancellation takes effect at the end of the current billing period; amounts already due remain payable.
No minimum commitment applies beyond the current period already engaged, unless special terms accepted by the Customer.
Withdrawal right
Professional Customers generally do not benefit from the consumer withdrawal right.
If a Customer qualifies as a consumer, mandatory legal withdrawal rules will apply.
Suspension and default
The Provider may suspend the Service for non-payment, breach of the terms, security risk, or a competent authority’s request, after informing the Customer when reasonably possible.
Suspension due to the Customer’s breach does not entitle them to a refund for the current period.
Liability
The Provider supplies the Service on a best-efforts basis. Liability is limited as set out in the terms of use.
The Customer remains responsible for loyalty or membership programmes, benefits promised to Cardholders, and legal obligations (including data protection).
Governing law and disputes
These terms of sale are governed by French law. The parties will first seek an amicable solution.
Failing that, competent French courts shall have jurisdiction, subject to mandatory rules.
