目的与适用范围

These terms of use (“Terms”) define the conditions for accessing and using the KARD SaaS platform, available in particular via getkard.fr.

KARD provides digital tools for professionals to manage: (i) a loyalty programme (points, stamps, offers, notifications) and/or (ii) a membership programme (member cards, sessions, venues).

Any use of the platform implies full acceptance of these Terms, together with the terms of sale and the privacy policy where applicable.

“Customer”: a professional individual or entity that subscribes to a KARD account for their business, club, association or organisation.

“User”: any person authorised by the Customer to access the workspace (admin, cashier or front-desk staff).

“Cardholder”: the Customer’s end customer or member who holds a digital card (Apple Wallet / Google Wallet) or is registered in the programme.

“Service”: the features provided by KARD under the subscribed plan (loyalty and/or membership).

访问与账户

Access requires creating an account with accurate, complete and up-to-date information. The Customer must keep it updated.

Credentials are personal. The Customer is responsible for access confidentiality, User permissions and all activity under the account.

KARD may suspend or restrict access in case of suspected fraud, non-payment, breach of the Terms/terms of sale, or security risk.

服务说明

Depending on the plan, the Service may include creating and managing digital cards, registering Cardholders, tracking points, stamps, sessions or benefits, sending notifications, dashboards and analytics, and inviting collaborators.

Exact features, quotas (stores/venues, staff, etc.) and options depend on the subscribed plan and are described on the Pricing page or in the applicable quote.

KARD may evolve the Service (improvements, new features, removal of obsolete features), without substantially altering the subscribed offer without reasonable prior notice.

Wallet 卡与第三方依赖

Adding cards to Apple Wallet and Google Wallet depends on Apple’s, Google’s and device conditions and policies. KARD does not control these third-party environments.

The Customer acknowledges that interruptions, limitations or changes from these third parties may affect Cardholders without necessarily constituting a breach by KARD.

客户义务

The Customer uses the Service in compliance with applicable law (including consumer, advertising and data protection rules) and these Terms.

The Customer alone remains responsible for: programme content (rules, rewards, sessions, communications), commitments to Cardholders, prior information to Cardholders, and GDPR compliance when acting as controller of Cardholder data.

The Customer ensures that entered data (including Cardholder data) is accurate, lawful and collected fairly.

禁止用途

In particular, the following are prohibited: fraudulent or unlawful use; spam or unlawful unsolicited communications; unauthorised resale or transfer of Cardholder data; unauthorised access, security attacks, unlawful reverse engineering, or use beyond granted rights; any activity infringing third-party rights.

知识产权与数据

KARD and its licensors retain all rights in the platform, software, trademarks and content provided by KARD.

The Customer retains rights in its business content and data, and grants KARD a limited, non-exclusive licence to host, process and display them solely to provide the Service.

Cardholder and Customer personal data are governed by the privacy policy and, where applicable, a data processing agreement.

可用性、维护与责任

The Service is provided on a best-efforts basis. KARD strives for high availability and may perform planned or emergency maintenance.

To the extent permitted by law, KARD is not liable for indirect damages (loss of revenue, customers, data due to abnormal use, reputational harm, etc.), nor for failures caused by force majeure, the Customer/User, or a third party (network operator, Apple, Google, host, payment provider).

Where permitted by law, KARD’s total liability under these Terms is capped at the amounts actually paid by the Customer (all taxes included) during the twelve (12) months preceding the event giving rise to liability.

期限、终止与适用法律

These Terms apply for the entire period of use. Account or subscription termination ends access, subject to surviving obligations (confidentiality, IP, liability limitations, etc.).

KARD may update these Terms. The applicable version is the one published on the site on the date of use. Material changes may be reasonably notified to the Customer.

These Terms are governed by French law. Failing amicable resolution, disputes shall be submitted to the competent French courts, subject to mandatory public-policy rules.
